1. Acceptance of Terms

By downloading, installing, or using the Willow mobile application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use the App.

2. Description of Services

Willow is an AI-powered application designed to help real estate professionals create property descriptions and enhance property marketing materials. Our services include but are not limited to:

Generating AI-powered real estate descriptions based on property details you provide
Processing property images you upload to enhance description generation
Virtual staging services that transform empty room photos into furnished spaces using AI technology
Allowing you to customize and save generated descriptions and staged images
Analyzing example descriptions you provide to fine-tune the AI output to match your style
Providing templates and formatting options for property listings
Access to a gallery of your previously generated virtual staging results

3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to update such information to keep it accurate and current. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. User Conduct

You agree not to use the App to:

Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Upload or share content that is defamatory, offensive, or otherwise objectionable
Upload images that you do not have the legal right to use or modify
Attempt to gain unauthorized access to any portion of the App
Use the App for any purpose that is unlawful or prohibited by these Terms
Generate descriptions or virtual staging for properties you do not have the right to market or sell
Use the generated content in a way that violates real estate laws or regulations
Misrepresent virtually staged images as actual property conditions without proper disclosure
Exceed usage limits or attempt to circumvent rate limiting mechanisms

5. Content Ownership and Rights

Our content ownership and rights are as follows:

App Ownership: The App and its original content, features, and functionality are owned by Willow and are protected by international copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of the property details, images, and example descriptions you upload to the App.
AI-Generated Content: You own the final property descriptions and virtual staging images that are generated by our AI and customized by you. However, we retain rights to the underlying AI models and technology.
License to Us: By uploading content to the App, you grant us a worldwide, non-exclusive license to use your content to provide and improve our services, including training and fine-tuning our AI models.
Virtual Staging Images: You represent and warrant that you have the right to upload and modify any images used for virtual staging. The staged images are provided for marketing purposes only and must be disclosed as digitally enhanced when used in property listings.

6. AI-Generated Content Responsibilities

Regarding AI-generated content from our App:

You are responsible for reviewing all AI-generated descriptions and virtual staging images before using them professionally
You must ensure all descriptions are accurate and comply with real estate laws and regulations
Virtual staging images are artistic representations and must be clearly disclosed as "virtually staged" or "digitally enhanced" when used in marketing materials
You are solely responsible for ensuring compliance with local real estate disclosure laws regarding virtually staged images
We do not guarantee that the generated descriptions or staging images will be free from errors, inaccuracies, or artistic inconsistencies
You agree to indemnify us against claims arising from your use of AI-generated content in your professional activities

7. Usage Limits and Rate Limiting

Our services are subject to usage limits based on your subscription tier:

Virtual Staging Limits: Daily limits apply to the number of virtual staging transformations you can generate (typically 3 for trial users, 10+ for premium subscribers)
Daily Reset: Usage limits reset daily at midnight UTC
Enforcement: We track usage on a per-user, per-day basis and will prevent additional requests once your daily limit is reached
Fair Use: We reserve the right to impose additional rate limits or suspend accounts that engage in abusive usage patterns
Limit Changes: We may adjust usage limits at any time with reasonable notice to users

8. Subscriptions and Payments

If you choose to purchase a subscription to the App:

All purchases are processed through the App Store and subject to Apple's terms and conditions
Subscription fees are billed in advance and may renew automatically unless canceled
Different subscription tiers provide different daily usage limits for features like virtual staging
You can manage and cancel your subscription through your App Store account settings
Refunds are handled in accordance with Apple's refund policy
Downgrading your subscription may result in reduced daily limits for certain features

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WILLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VIRTUAL STAGING IMAGES WILL ACCURATELY REPRESENT HOW FURNITURE WOULD APPEAR IN THE ACTUAL SPACE OR THAT AI-GENERATED CONTENT WILL BE ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP. THIS INCLUDES BUT IS NOT LIMITED TO ANY CLAIMS ARISING FROM THE USE OF VIRTUALLY STAGED IMAGES IN PROPERTY MARKETING OR SALES.

11. Termination

Willow may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. Your stored content, including virtual staging results, may be deleted following account termination.

12. Changes to Terms

Willow reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
